NEW YORK (Reuters) - Pfizer Inc on Friday will lose its patent exclusivity for its blockbuster antibiotic doxycycline - commonly known as doxycycline - for a period of up to seven years and a settlement with US generic manufacturer Teva Inc will be delayed until at least 2014.

The company is in the middle of a $3.5 billion settlement that will include a temporary restraining order for the company's share price from Teva. The temporary restraining order is expected to be signed by U. S. and international antitrust officials in the next few weeks.

U. Attorney for the Southern District of Illinois Paul G. Steenbauer is investigating the Teva matter and will make an initial announcement at a press briefing to analysts in New York in early May. He will also announce whether a temporary restraining order in the case is the only option for Teva to delay a generic competition.

The company will continue to market the product as a generic and will make its own generic versions of the drug in late-stage marketing programs and in late-stage research and development for its drugs, said Steenbauer. Teva will also continue to manufacture and market its own generic products under the trade name "Pulmicort" until it loses exclusivity in late-stage marketing. Pfizer said it would lose its exclusive rights to doxycycline from Teva until early 2014.

The temporary restraining order will prevent Teva from entering the market until late 2014. It is expected to be signed by U. and European regulators by late-stage marketing and development firms and will be submitted to the court in early May. Teva is expected to lose most of its exclusivity in the U. market after the U. Food and Drug Administration's (FDA) rejection in 2010 of a similar drug, but Teva still has a market exclusivity of roughly 15 years, according to an IMS filing. Pfizer also said in a statement it will seek approval for an international patent for doxycycline, which has a 10-year patent and will be available to enter the U. market by late-stage marketing or early-stage development, for six years. Pfizer's patent expires in 2014. Teva will still face generic competition until late 2014.

The deal comes after an IMS filing in June showed an average price for the antibiotic had dropped to just over $3.4 billion in the U. market. In the U. S., Pfizer had an average price of about $1.9 billion, according to IMS data. Pfizer's price for doxycycline in the U. has also increased, up from $1.4 billion in 2012.

Teva, the U. generic company, said it would pay Pfizer $1.4 billion to settle the Teva matter and will have its stock price down to about $90 a share in mid-2014, while Teva will pay the IMS filing to resolve the Teva matter and make an initial payment in early 2014. The Pfizer share price would be $90 in the U. market, and the IMS filing would be delayed until late 2014.

The company has agreed to pay Teva $1.1 billion, as well as the other pharmaceutical companies that are expected to file U. and European patent litigation in the coming weeks. Pfizer, Teva, IMS, and other generic companies will pay a combined $2.2 billion in compensation to settle the Teva matter and a combined $3.5 billion to delay the generic competition.
